Dean Seman, a former environmental engineer, defends business owners and companies in construction defect and accident matters as well as environmental matters.
Dean has state and federal court litigation experience, including trials, involving alleged defects in large residential developments, condominiums and single family homes. He also handles complex construction accident claims, including product liability aspects.
His environmental litigation experience includes the defense of environmental consultants and laboratories in professional negligence matters as well as more traditional environmental issues arising from storage tank releases, fracking, Superfund, Brownfields, waste handling issues under the Resource Conservation and Recovery Act (RCRA) and. He also handles permit issues and Pennsylvania Department of Environmental Protection corrective action matters. Dean previously represented the Pennsylvania Underground StorageTank Indemnification Fund.
Obtained a highly favorable settlement during the defense of an environmental laboratory involving allegations of negligent reporting, which allegedly affected the development and marketing of remedial technology related to the coal mining industry. This complex matter involved the feasibility of the remedial technology and engineering as well as speculative economic future earnings and patent claims.
Obtained favorable settlements and results in defense of emergency restoration companies by focusing on causation issues and factual gaps against allegations of negligent water loss remediation causing property damage and mold growth.
Obtained favorable settlement in construction defect claim in Philadelphia involving the conversion of an existing building into a condominium. The condominium association brought suit against the architect, developer, general contractor and numerous subcontractors. Dean represented a glazing company, which installed a curtain wall. A favorable settlement was obtained by focusing on inconsistencies in the water and air infiltration claims by emphasizing aspects of heat transfer, condensation and appropriate interior climate control.
