Professional Experience:

Michael A. Moroney is the Managing Partner of the Firm's Murray Hill, New Jersey office and practices primarily in the Firm's Healthcare Law and Product Liability Groups. Mr. Moroney has experience litigating a broad range of product liability cases, commercial disputes, insurance defense matters and other civil litigation. He has extensive trial experience in both state and federal courts, and has achieved an AV Peer Review Rating from Martindale-Hubbell. In 2011, Mr. Moroney was recognized by the publishers of the New Jersey edition of Super Lawyers magazine.

Mr. Moroney represents Physicians, PPO's and healthcare institutions in both Federal and State courts with regard to regulatory, compliance and Fraud & Abuse issues. He also represents several clients in asbestos actions, coordinating their defenses in a number of jurisdictions.

Mr. Moroney has lectured on a number of topics, notably healthcare law issues concerning Fraud & Abuse, the False Claims Act, Stark laws, the Anti-Kickback Statute and Compliance plans, on behalf of the Medical Society of New Jersey, and has authored the manuals used as course materials. Mr. Moroney authors several articles a year on various product liability and litigation topics, which are distributed directly to selected clients and published in trade journals and magazines. He also lectured extensively on collection law, on behalf of the National Business Institute.

Active in his community, Mr. Moroney is involved with a number of youth organizations, including U.S. Lacrosse, the Long Valley Lacrosse Club and the Long Valley Travel Baseball Club, has served as President of the West Morris Central Soccer Club and is a member of the New Jersey Vietnam Veterans Memorial Foundation. Mr. Moroney and his family are lifetime members of the United States Tennis Association.

Mr. Moroney is actively involved with Lafayette College, serving as Chairman of the Skylands Alumni Chapter, a member of the Alumni Leadership Council, a member of the Lafayette Parents' Council, a volunteer to the Mock Trial program, a member of his fraternity's house corporation, and as a member of the Maroon Club supporting Lafayette's varsity athletics. He also serves as an Alumni Admissions Representative for Lafayette College, interviewing prospective high school students seeking admission, and serves in a similar capacity for the College of William & Mary. He has also served as an Adjunct Faculty Member at Raritan Valley Community College, teaching Business Law to undergraduate students.


Significant Cases & Trials

Mathesen adv. WTC Victim's Compensation Fund: Represented a 9/11 widow in a claim against the WTCVCF. Set up a charitable fund, and handled the donations to same, as well as appealing the presumptive award from the Fund and succeeded in obtaining an award of $4.4 million.

Ozimek v. Helm Industries: Defended the manufacturer of a tow bar that was alleged to be defective, causing a truck accident wherein plaintiff lost his right arm when his truck flipped over on the Betsy Ross Bridge, pinning his arm between the road and the sunroof of his truck. Jury returned a "no cause" after nine days of trial.

Telymonde v. Sea Ray Boats: Defended Sea Ray Boats against claims of defective design and manufacture, breach of UCC warranties and violation of the Consumer Fraud Act. Dismissed all Consumer Fraud counts by summary judgment motion; won motion to bar plaintiff's liability expert on P/L issues and to bar plaintiff's appraisal expert on UCC warranties; also simultaneously awarded recovery of legal fees.

Ciminello v. Deer Park Stairbuilding: Defended the manufacturer of a prefabricated staircase which collapsed during the construction of a new home, seriously injuring the plaintiff who was a carpenter on site. The case was tried twice (first ending in a mistrial). Prevailed on a motion for directed verdict at the close of evidence and before closing arguments; trial went on and plaintiff received several hundred thousand dollar verdict against remaining defendants (GC, subcontractors).

Slowinski v. Wood Ply Corp. of America: Represented the manufacturer of a two-ton yard ramp used to help unload railroad cars in wrongful death claim alleging defective design/manufacture (specifically the hydraulic system). Plaintiff had been called to effect repairs to the ramp when it collapsed, killing him. Won a summary judgment motion upon basis that no duty was owed to an independent contractor to protect him from the very hazard he was called upon to repair.

Steider v. Trustees of Madison Lodge: Represented a Lodge against a slip and fall claim brought by a woman who attended a function at the lodge premises, which had been loaned out for the evening to another group. Won a summary judgment motion premised upon doctrine of charitable immunity; successfully defended plaintiff's subsequent appeal of that ruling.

Halligan v. Historic Speedwell: Case involving a slip and fall on premises owned and operated by a non-profit organization. Prevailed on a summary judgment motion and successfully defended against the subsequent appeal of that ruling by plaintiff.

Mr. Moroney is admitted to practice in both the State of New Jersey and the District of Columbia and is a member of the New Jersey, District of Columbia and Morris County Bar Associations. He is a member of the Defense Research Institute and its Product Liability and Fire & Casualty Loss subcommittees, the New Jersey Building Materials Dealers Association and the New Jersey Vietnam Veterans Memorial Association. Mr. Moroney is also a member of the American Health Lawyers Association (AHLA) and a Corporate Partner of the Medical Society of New Jersey (MSNJ).
