January 31, 2006 : Richard D. Arnold Obtains Favorable Workers' Compensation Decision

Richard D. Arnold, a partner in the Newark office of Weber Gallagher Simpson Stapleton Fires & Newby LLP, obtained a favorable decision in a workers' compensation trial in Paterson, New Jersey on behalf of an employer.  

The Judge originally recommended that the employer pay 50 percent of partial total disability, or $79,800 for orthopedic, neurological and neuropsychiatric disability, thereby subjecting the employer to future exposure for treatment and additional permanent disability benefits. Based upon the discrediting of the petitioner and her medical experts at trial, the Judge found disability of 15 percent of partial total, or $11,880 for orthopedic impairment only.  Additionally, the Judge ruled out all neurological and neuropsychiatric disability.  Finally, the Judge found the petitioner had developed a subsequent condition and ruled out any future liability for treatment and benefits.
