Zachary M. Rubinich, a partner in the Firm's Philadelphia office, has published an article entitled "Supreme Court of Pennsylvania Addresses 'Employer-Employee Relationship' Scenario Under the Act" in the Pennsylvania Self-Insurers' Association's (PSIA) recent newsletter.
In its March 2007 newsletter, PSIA published Mr. Rubinich's article, which analyzed the Pennsylvania Supreme Court's December 27, 2006 decision of Brookhaven Baptist Church v. Workers' Compensation Appeal Board (Halvorson). In his article, Mr. Rubinich reviewed the Court's decision concerning a clarification of the term "employer-employee relationship" as utilized in the Pennsylvania Workers' Compensation Act. He also cited the Court's seven key elements for consideration to determine whether an "employer-employee relationship" existed at the time of the injury or death in order to determine the potential existence of a legal defense to payment of compensation benefits pursuant to the Pennsylvania Workers' Compensation Act.
