March 02, 2006 : Brian L. Calistri Obtains Defense Verdict, as Jury Rejects Premises Defect Claim

Brian L. Calistri, a partner in the Philadelphia office of Weber Gallagher Simpson Stapleton Fires & Newby LLP, obtained a defense verdict on February 22, 2006 in Delaware County, Pennsylvania.  Mr. Calistri represented a financial planning company that was sued by the plaintiff after she fell in a hole on the company's property.  The plaintiff, who was a laborer hired to perform landscaping work on the premises, suffered a herniated disc.  The jury concluded that the company had maintained its property reasonably and was not liable for the injury, despite the higher standard of care that the plaintiff, as a business invitee, was owed under Pennsylvania law.
