April 06, 2006 : Jeffrey T. Strittmatter Prevails in PA Workers' Compensation Decision
Jeffrey T. Strittmatter, a partner in the Pittsburgh office of Weber Gallagher Simpson Stapleton Fires & Newby LLP, has won a decision from Workers' Compensation Judge Rosalia Parker denying and dismissing a claimant's petition for wage loss and medical benefits relating to his alleged work injury. In reaching her decision, the Judge found that claimant's allegations of psychic injury to be based primarily on subjective perceptions as opposed to objective working conditions and, in doing so, cited the reasonable and timely measures taken by the employer's management to addresss the situation. The Judge also noted the measures taken by management after the accident to accommodate an immediate return to work by the claimant with accommodations for parking and access to the facility.
