July 14, 2006 : PA Supreme Court Lets Stand Multi-Million Dollar Verdict Obtained by Weber Gallagher Attorneys

The Pennsylvania Supreme Court recently denied review of one of the largest jury verdicts ever delivered in Luzerne County, Pennsylvania, a case litigated by Weber Gallagher partners Marc B. Zingarini and Thomas E. Butler, Jr. and former partner - now Philadelphia Court of Common Pleas judge - Susan Schulman.

The Firm's attorneys obtained a $20.5 million jury verdict on behalf of their client, Wachovia Bank, in an action against a sprinkler system manufacturer held liable for a 1997 warehouse fire in West Pittston, Pennsylvania that destroyed millions of stored documents.  The trial judge awarded Wachovia - then First Union Corp. - more than $6.4 million in delay damages.  Wachovia is also entitled to post-judgment interest that has been accruing since the verdict was issued in December 2002.  The Supreme Court's one-page order denying allocatur lets stand an August 2005 decision by the Pennsylvania Superior Court that rejected the manufacturer's appeal.
