October 05, 2006 : Weber Gallagher Attorneys Obtain Clients' Dismissal From Medical Malpractice Action

Two pediatric hematologists/oncologists and a Philadelphia hospital represented by Weber Gallagher attorneys were dismissed from a medical malpractice action on September 12, 2006 after the trial judge granted a motion for non-suit on the first day of jury selection.   Partner Regan S. Safier and associate Lisa Swiatek represented the defendants.

The defendants were sued for negligent management of a child in a sickle cell crisis with pneumonia.  The child needed a periocardiocentesis, during which she suffered cardiac arrest and developed significant brain damage as a result.  The judge granted the defendants' motions to preclude the testimony of two of the plaintiff's experts and substantially limit the testimony of a third expert, whose reports were either submitted late or were inadequate.  Once those motions had been granted, the plaintiff had inadequate expert support to proceed with his claim and the non-suit was granted.
