July 20, 2007 : Michael B. Pullano Wins Trial of Personal Injury Action

Michael B. Pullano, a partner in the Firm's Philadelphia office, successfully defended a client in a personal injury action at trial before the Hon. Marlene Lachman in the Philadelphia Court of Common Pleas.  The plaintiff was a waiter who suffered an allegedly career-threatening injury on the property owned by Mr. Pullano's client, a limited partnership. 

The plaintiff's case-in-chief took four days and after the plaintiff rested, Mr. Pullano moved for non-suit based on the argument that knowledge of the condition on the premises could not be imputed to his client just because a limited partner in the Limited Partnership had knowledge of the condition.  Because there was no proof that the general partner had knowledge of the accident (or that the limited partner who allegedly had knowledge was anything other than a limited partner), the Judge granted non-suit.  The plaintiff's claim for lost earnings was approximately $150,000 and lost future earnings was $1.2 million.
