January 18, 2008 : John P. Kickbusch Secures Workers' Compensation Win
John P. Kickbusch, an associate in the Firm's Cherry Hill office, recently secured a dismissal of a Workers' Compensation claim after multiple days of trial over the course of eight months. The petitioner presented testimony indicating that she injured her low back as a result of a work-related lifting incident. The petitioner was seeking to compel the payment of temporary disability benefits and the provision of medical treatment.
Mr. Kickbusch offered the testimony of three supervisors from the employer, who testified extensively that no injury was ever reported, that the petitioner never requested treatment or asked to see a doctor.
The Court found the defense witnesses highly credible and opined that the petitioner’s filing of the claim was financially motivated. The judge entered an Order denying the petitioner’s Motion for medical and temporary disability benefits in its entirety and also dismissed the claim petition with prejudice for failure to sustain the burden of proof.
