June 11, 2009 : Mary E. Sherlock Obtains Defense Verdict in Trip and Fall Case
Our partner, Mary E. Sherlock, Esq., in our Dover, Delaware office obtained a defense verdict in a trip and fall case after a 2 day jury trial in the Superior Court of New Castle County, Delaware. Liability was strongly contested.
The plaintiff was represented by Richard Morse, Esq. of the law firm of Young, Conway, Stargatt & Taylor. Plaintiff's liability expert said the entranceway to Defendant's model home was not to Code and was unsafe.
Defendant's expert, Dr. Gregory Harrison, a civil engineer and safety expert testified the landing, in question, was built to Code and was safe. Plaintiff sustained a broken ankle and had $30,000 in boardable medical bills.
