June 07, 2009 : Worker's Claim Petition Denied

Partner Zachary M. Rubinich and associate Lori A. DePolis successfully represented an employer in defeating an employee's claim petition in Philadelphia. The Judge found that the claimant did not sustain cellulitis of this lower left leg as a result of his job duties as a security guard. The Judge agreed with the employer's argument and expert medical opinion that the development of the claimant’s cellulitis was longstanding in nature and not related to his sedentary work duties. The favorable decision saved the client about $22,000 annually in indemnity benefits, along with medical benefits and litigation costs from claimant’s counsel.
