March 26, 2010 : Catherine Flynn Obtains Verdict for Physician and Hospital
Murray Hill-based partner Catherine J. Flynn obtained a defense verdict in favor of her clients, an emergency-room physician and the hospital involved in the plaintiff's treatment. The patient filed suit asserting claims of medical malpractice. The physician was alleged to have failed to diagnose a significant spinal cord compression, originally resulting from a work-related accident. The plaintiff, who had presented to the defendant hospital emergency room and who was seen by the defendant physician, failed to provide a complete history to the defendant at the time of the visit. The defendant physician who took the history also examined the plaintiff and discharged him with instructions to seek follow-up care. During the trial, which took place over four weeks, the jury heard testimony from experts in internal medicine, emergency medicine and neurosurgery. Plaintiff's alleged damages included claims that he was totally disabled and unable to work or participate in any activities of daily living. The Hudson County jury returned a verdict of no cause for action in favor of both of Ms. Flynn's clients.
