April 28, 2011 : Scranton Attorneys Obtain Summary Judgment in Slip and Fall Case
Eugene Feeney, Noah Katz and Tom Geroulo obtained a summary judgment in a case involving claimed injuries for a slip and fall in the lobby of a commercial building. The Plaintiff claimed total disability and produced a report from an economic expert claiming total loss of earnings and household services in excess of $300,000.
The case involved a fall in the lobby of a commercial building at which the firm's client was contracted to perform snow removal services. The Motion for Summary Judgment was based on both the language of the lease and a causation argument that the Plaintiff could not recover for a fall on an allegedly wet lobby floor against the Defendant who was only responsible for snow removal on the exterior of the building.
