June 25, 2011 : Zachary M. Rubinich Obtains Favorable Workers' Compensation Decision
Zachary Rubinich received a favorable Opinion and Order issued on June 15, 2011 from the Commonwealth Court of Pennsylvania denying a Petition for Review filed by a wife on behalf of her deceased spouse seeking a reinstatement of his compensation benefits following a work injury. Mr. Rubinich had previously successfully defended a Petition to Reinstate Compensation Benefits and Petition to Review to expand the description of a work-related injury. The Commonwealth Court determined that Employer proved that Claimant misrepresented his physical abilities, concealed his self-employment and because of his misconduct was properly terminated by his Employer making his subsequent loss of earnings attributable to his own fault, and not the work-related injury.
