October 31, 2012 : Koczan, Pakravan Deliver One-Two Punch To Defeat Medical Malpractice Claim
Associate Shari Pakravan capped a jury trial victory by Weber Gallagher's Partner Paula A. Koczan in a medical malpractice suit by persuading the Superior Court of Pennsylvania on October 23, 2012, to reject the plaintiff's appeal.
After the jury found for Weber Gallagher's physician client, the plaintiff appealed the decision based on the trial court's failure to strike three jurors. One juror was a co-worker of the physician, and the other two had immediate family members who are her patients. However, the three-judge panel agreed, 2-1, with Ms. Pakravan's argument that the trial judge is in the best position to observe jurors and determine whether they should be struck.
Ms. Koczan, Chair of Weber Gallagher's Medical Professional Liability Group and partner in charge of the firm's Pittsburgh office, is a registered nurse with extensive experience in state and federal courts defending healthcare providers in medical malpractice, licensure, and Medicare fraud actions. She also handles medical product liability and toxic tort actions.
