October 03, 2005 : Richard K. Tavani and Laurence T. Bennett Present Subrogation Seminar
On September 22, 2005, Richard K. Tavani, a partner in the Cherry Hill office of Weber Gallagher Simpson Stapleton Fires & Newby LLP, and Laurence T. Bennett, an associate in the Cherry Hill office, presented a seminar at ARI Insurance in Lawrenceville, New Jersey on the prosecution of subrogation claims in New Jersey and Pennsylvania.
Mssrs. Tavani and Bennett discussed the rights that insurance companies have in both states as subrogation litigants. They also stressed the importance of conducting comprehensive fact investigations in cases to determine the suitability of filing subrogation actions. In addition to discussing the procedural requirements of the courts in both states, the attorneys also discussed the legal concepts of comparative negligence, joint and several liability, wrongful death and survival actions, commercial premises liability, and provided an overview of the statute of limitations for various causes of action in both states.
