ExperienceReceived favorable order from the Delaware Industrial Accident Board. The Board denied an employee’s motion seeking payment of medical bills and damages. The Industrial Accident Board determined that the bills were all properly denied and were not compensable. The employer avoided considerable exposure for medical treatment and damages. Obtained a decision granting a Utilization Review Petition, in which the Judge found the employee’s use of prescription narcotics, including methadone, to be unreasonable. The case relieved the employer from the considerable financial burden of paying for these expensive medications. Won a trial in New Castle County, (Delaware) Court of Common Pleas in a subrogation claim resulting from a motor vehicle accident. The evidence established that the debris from the crash was located in the insured's lane of travel, proving that the defendant had crossed into oncoming traffic and was liable for the accident
