ExperienceSuccessfully argued for denial of a claim petition, alleging an entitlement to ongoing disability benefits for disc-herniations and left lower extremity radiculopathy, on the basis the employee had failed to provide any notice of an alleged cumulative-type work injury within 120 days. Successfully argued for a denial of a Penalty Petition, where an employee alleged she lost a significant business opportunity as a result of the untimely receipt of her workers’ compensation settlement check. Successfully defended a Petition to Review, challenging a Notice of Change of Workers’ Compensation Disability Status filed upon receipt of a less than 50 percent impairment rating evaluation performed under the 6th Edition to the AMA Guides to the Evaluation of Permanent Impairment. Successfully argued the ‘automatic’ change of status should stand after a new impairment rating, also under a 50 percent whole body impairment, had been obtained under the 4th Edition of the Guides in light of Protz v. WCAB (Derry Area Sch. Dist.), 124 A.3d 406 (Pa. Cmwlth. 2015). Protz is presently pending on appeal before the Pennsylvania Supreme Court.
