ExperienceSuccessfully defended a claim by house cleaner against home owner for a workplace fall. The housecleaner alleged sustaining work related injuries on April 2, 2012, during the course of her job duties when she fell and injured her shoulder, arm and back. Defended issue on compensability. The housecleaner had $10,000 in bills with a doctor recommendation for rotator cuff surgery and a value between $50,000 and $100,000 overall. With help of the insured, we were able to convince the Judge that her work did not meet the statutory threshold and we settled for trial costs of $3,500 full and final Section 20. Defended an occupational claim where the petitioner alleged that while working as a dental hygienist she sustained carpal tunnel syndrome. The petitioner filed a Second Injury Fund looking for permanent disability. In our handling of the claim, we noted significant questions of causal relationship, an intervening MVA and other sundry issues. We resolved our portion of the claim for only $5,000 (Section 20).
