Won an appeal in Superior Court in Harrisburg involving the transfer of a wrongful death case from Luzerne County to Lycoming County. We represented two Lycoming County nonprofit corporations which provide services and raises funds for individuals with developmental disabilities. Tragically, a young man choked and died at one of the defendants’ group homes in Williamsport, Pennsylvania. The estate instituted a wrongful death action in Luzerne County. The Luzerne County court sustained preliminary objections on venue we filed, which argued that the two nonprofit corporations did not regularly conduct business in Luzerne County so the case must proceed in Lycoming County. The estate appealed the decision to the Superior Court.
