Contractors and subcontractors in commercial, residential, industrial and government projects engage us in matters including construction defects, on-site accidents, product liability and occupational exposure. Where appropriate, we seek resolution through mediation or arbitration. When alternative dispute resolution is not an option, we draw on our experience before state and federal courts, as well as in administrative proceedings.

  • Represented a building materials manufacturer in multi-party construction litigation involving eight-figure damages to a structure. The plaintiff alleged the products manufactured by our client were defective in their design and, because of that, the plaintiff’s building had suffered serious structural damages. Our position was that there was no defect in the design of our client’s product, which allowed for various forms of use within the industry, and the building’s structural integrity had been compromised due to the failures of other materials utilized in the construction process and/or improper use and maintenance by the plaintiff.  Our client paid a proportionately nominal amount to obtain a dismissal of all claims against it.

  • Successfully obtained summary judgment for commercial clients including engineers as professionals in construction defect cases and personal injury matters and sellers in product liability cases.

  • Successfully obtained contractual defense and indemnification and defended against providing contractual defense and indemnification for various commercial clients including engineers, property owners, landlords, tenants, general contractors and subcontractors.

  • Obtained dismissal for a HVAC contractor who was alleged to have left an area of construction unsecured, resulting in personal injury.

  • Secured dismissal on behalf of home builder who was alleged to have damaged utilities while performing foundation work.

  • Obtained dismissal of a large home builder in a hybrid commercial liability/wrongful death lawsuit, using affidavits to highlight weaknesses in the plaintiffs' theory of liability and undermine their expert's opinions.  

  • Obtained summary judgment on behalf of a contractor client who was alleged to have destroyed a utility pole on his job site.
