Darren Audino counsels and defends clients in general liability, product liability and commercial transportation matters.
Darren has extensive experience with general liability and premise liability matters. He handles matters including construction accidents, construction defects, dram shop liability and food poisoning cases. Among his clients are a prominent national restaurant group and bars and restaurants including chains and individually owned establishments. He counsels them in contract matters, advertising issues and regulatory matters. Darren also represents restaurant employees in licensing, regulatory issues and criminal matters.
In premises liability matters, he has represented condominium complexes, commercial apartment buildings, commercial landlords and tenants, general contractors and restaurants. Darren’s experience includes slip and falls, assaults, staircase, elevator, sidewalk and parking lot accidents and falls at construction sites. He also represents commercial campgrounds in property damage matters, wrongful death, bicycle and ATV accidents and playground equipment accidents.
In addition, Darren handles commercial transportation matters on behalf of motor coach carriers, school buses, taxis and limousine services, tractor trailers companies and also represents a major national parcel delivery corporation. For these companies, he negotiates settlements, provides counsel in matters including personal injury defense, wrongful death, property damage and regulatory issues and advises on risk management. He routinely defends commercial drivers throughout New Jersey in municipal court for traffic violations.
For the past six years, he has been selected by the publisher of the New Jersey edition of Super Lawyers magazine as a "Rising Star." The Super Lawyers list is issued by Thomson Reuters. Darren was also named in the 2011 edition of SJ Magazine's Top Attorneys in South Jersey. Darren was chosen as a 40 Under 40 success in South Jersey by SNJ Business People in 2016.
Successfully represented a national restaurant chain in a case where a patron sued for in excess of $500,000 claiming he was injured when feeling a burning sensation on his face after being served a hot plate of food. The Superior Court of New Jersey granted summary judgment in favor of the restaurant chain. The plaintiff appealed the decision to the Appellate Division which affirmed the lower court’s ruling in favor of the restaurant.
Obtained summary judgment on behalf of a mattress products manufacturer under New Jersey’s “loading and unloading doctrine” whose tractor trailer was delivering a product to a warehouse in New Jersey. The plaintiff sustained severe personal injuries when he was run over by a forklift during the unloading of the trailer. The plaintiff’s demand was in excess of $1,000,000.00.
Successfully represented the maker of an aerosol spray product when a plaintiff sued for in excess of $1 million saying he sustained serious injuries when he slipped on the spray. The case settled for under $30,000.
