Delaware Workers' Compensation Alert Update

On March 31, 2020, the Chair of the Delaware Industrial Accident Board Mark Murowany issued his third order regarding hearing procedures during the COVID-19 restrictions. Moving forward, the Board has established the following:

1. All hearings through April 12, 2020, are considered suspended and continued;

2. As of April 13, 2020, there will be availability to hold hearings via video conference (WebEx), and this will include legal motions and evidentiary matters. The Court will allow video hearings under the following conditions:

  • The parties must agree to the matter being heard by a hearing officer;
  • All participants (counsel, witnesses, parties) must have the capability to participate from a technological standpoint;
  • All exhibits must be submitted electronically to the Chief Hearing Officer, and marked, at least 24 hours in advance of the hearing;
  • Hard copies of the exhibits should be mailed to the Chief Hearing Officer after the hearing, and only a single copy is required;

3. In the event the above requirements cannot be met, the hearing will be deemed continued and rescheduled.

The above reference is significant in that it reflects the Board’s technical capacity for handling hearings electronically, including live witnesses.
