ExperienceSuccessfully defended a large manufacturing client in a Pennsylvania workers’ compensation claim petition. The worker alleged injury in a forklift accident. The Workers’ Compensation Judge awarded benefits. On appeal, the award was reversed due to a legal argument that the worker failed to show that the alleged injury prohibited him from working. The employer was able to secure $86,000 from the Supersedeas Fund. Successfully obtained termination of benefits and defended against a claim for reinstatement of indemnity benefits and a more expansive injury description when representing a national automotive distributor. As a result of the decision, the defendant saved nearly $50,000 and is not responsible for ongoing medical and indemnity benefits. The Workers’ Compensation Judge rejected the employee’s testimony as not credible and accepted the IME doctor’s opinions on the issue of recovery and extent of the work injury.
