Obtained a dismissal of the petitioner's claim. The petitioner sustained a compensable work injury to the shoulder, ankle, and arm. Two years post-loss, petitioner fell on a trip (no accident reported) and had emergency cervical spinal surgery. The petitioner claimed it was related to the work injury, and the healthcare carrier tried to assert a lien. The judge dismissed that portion of the petitioner's claim. The remaining shoulder, ankle, and arm injuries settled for a $35,000 section 20 payment.
Successfully defended a claim where the petitioner underwent unauthorized surgical intervention. In this matter, petitioner sustained a compensable injury to her back, left shoulder and arm, neck, head, left hip, and leg. Following that loss, the petitioner was provided with a brief course of conservative medical treatment. The petitioner then sought unauthorized treatment and surgery. Through investigation and discovery, we were able to determine that the petitioner had a pre-existing history of injuries to the lumbar spine with prior lumbar surgery. The medical expert ultimately determined that the unauthorized surgery was not related to our work injury.
Obtained defense verdict for client at trial involving allegations of multiple cervical disc herniations and a torn rotator cuff as result of a work accident and 25 years of occupational exposure.
Obtained defense verdict for client at trial involving a denied work accident with surgical repair of a torn rotator cuff.
Defended an application for review and modification of a prior award where the petitioner received a prior award of 30 percent of partial total. We tried the matter and the judge found no increase in disability and dismissed the case for failure to sustain the burden of proof.
Prior results cannot and do not guarantee or predict a similar outcome with respect to any future matter that we or any lawyer may be retained to handle.
