Cases and Experience

Successfully tendered full defense and indemnification on behalf of a large commercial client with a high self-insured retention in a personal injury lawsuit falling under New York’s tough labor laws involving the potential for high damages, completely eliminating the popular American food chain’s exposure and future defense costs and obtaining reimbursement for past defense costs, saving the client tens of thousands of dollars and putting money spent back in its pocket.

Won a defense verdict on behalf of a high-end specialty grocery store in a food poisoning case before the NY State Supreme Court, NY County. The 73-year-old plaintiff allegedly sustained a mast cell activation disorder as a result of developing scombroid poisoning after consuming food sold by our client. Following a trial where we convinced the jury that there was no correlation between the scombroid poisoning and the resulting hypersensitivity disorder other than the coincidental timing, the jury ruled in favor of our client, awarding the plaintiff $1,000 for her past pain and suffering and zero dollars for her future pain and suffering.

Successfully obtained a dismissal in an NYC OATH hearing on behalf of firm client, multinational hospitality company based in New York City. The matter involved a City Administrative Code Violation asserted by a citizen petitioner. This particular petitioner was a known culprit who would go around issuing violations in the hopes to gain a financial benefit, if the violation resulted in a fine paid to the City in that the petitioner would receive half of the money. At the hearing, the petitioner appeared and presented photographs and video evidence. Alex effectively presented arguments demonstrating not only that the violations were improperly brought against our client but also effectively defeating the violations on their merits.
