Thomas Park is a formidable civil litigator who focuses his practice on workers’ compensation litigation defense and counseling.
Thomas represents employers, companies, and businesses in complex civil litigation and workers’ compensation cases before state and federal courts and agencies. His clients operate in a range of industries, however, he has significant experience advising employers in construction, transportation, and entertainment. Thomas has also successfully represented some of the largest self-insured companies and insurance carriers before the New York Workers’ Compensation Board.
In addition, Thomas represents clients in civil litigation matters involving construction accidents and Labor Law 240 cases. He also provides carriers with representation in arbitration proceedings instituted by medical providers. He has served as an expert witness on the subject of Workers’ Compensation law in New York during an arbitration proceeding.
Won a motion for summary judgment on a complicated construction accident case in New York Supreme Court, Nassau County, involving approximately nine defendants. The Plaintiff, a stage worker, fell through a platform while constructing a concert stage at the Nassau Coliseum. Our client was a payroll processing service and the admitted employer of record. The judge agreed with all of Tom’s arguments that the defendant who brought our client into the case did not have a contract with our client, and our client did not have any authority to supervise or control the work.
Obtained a trial victory on behalf of a general building contractor before the NYS Workers’ Compensation Board in a case where a claimant alleged he was assaulted by two coworkers. Based on the cross-examination, the Judge did not believe the claimant was actually physically contacted, and there was sufficient evidence that the claimant was the initial aggressor, therefore the case was disallowed.
Obtained a significant victory on behalf of a structural steel fabricator before the NYS Workers’ Compensation Board in a workers’ compensation claim where the claimant alleged that he has fallen from 7 feet and injured his right knee, hips, and back at work. The claimant was found not credible due to the lack of medical evidence as well as evidence that the accident occurred, and the claim was disallowed.
Secured a rare victory on behalf of a general building contractor before the NYS Workers’ Compensation Board in a claim for benefits where the claimant alleged that he has fallen from 20 feet and injured his back at work. Through a cross-examination of the claimant and the presentation of the employer witness, the claimant was found not credible, and the claim was disallowed.
