Successfully persuaded a jury to return a defense verdict in favor of two orthopedic surgeons and their practice group after a five-day trial, where plaintiff alleged that the surgeons did not timely diagnose a knee infection following surgery, causing permanent damage. Plaintiff had asked the jury to award him lost wages, future loss of earning capacity, pain and suffering, and loss of life’s pleasures.
Successfully defended a doctor in a case involving a spinal surgery and placement of a posterior fusion device where the plaintiff alleged the doctor failed to adequately achieve a fusion at the L4-L5 disk level and that the plaintiff was not a proper candidate for the surgery. After a short deliberation, the Lehigh County jury returned a unanimous verdict in favor of the defendants.
Secured a significant trial victory in the Luzerne County Court of Common Pleas. The plaintiff alleged that the defendant medical providers were negligent in their administration of anticoagulation medication to the decedent during her stay at a rehabilitation hospital. Gene represented two doctors and a physician’s assistant and successfully argued the rehabilitation providers followed the recommendations of the decedent’s neurosurgery team and acted within the standard of care at all times. The jury deliberated for only 40 minutes and returned with a 12-0 defense verdict, resulting in a win for his clients.
