Krista is an experienced litigator defending clients in various insurance defense related issues, including general liability, subrogation, premises liability, and employment matters. Additionally, Krista manages the defense of motor vehicle accidents, construction defects, medical negligence, and product liability.
Handling all phases of litigation up to and including trial, Krista works with her clients to develop defense strategies, negotiate settlements, attend alternative dispute resolutions, and interpret contract and lease language to provide the most cost-effective way to handle a case. Krista has successfully argued cases before the Supreme Court of Delaware, the District Court of Delaware, and the Appellate Court.
Krista’s experience includes working as an Assistant City Solicitor, representing the City of Wilmington and its officers in discrimination and civil rights actions. She has managed employment and labor-related matters, including those before the EEOC, the Delaware Department of Labor and Public Employment Relations Board, and arbitrations before the American Arbitration Association. Krista also defended the City against unfair labor practice charges, negotiated collective bargaining agreements, revised, and updated personnel policies, and performed preventive counseling in all City departments.
Secured a motion to dismiss on a case involving uninsured motorist coverage for a collision involving a horse and buggy.
Secured a defense verdict for a sexual orientation case after a five-day jury trial in the Superior Court of Delaware. The jury ruled in favor of our client on one count of discrimination.
Secured partial summary judgment on behalf of a condominium association in a case of first impression involving short-term rental restrictions, with the court upholding the amendment process and addressing application of the Delaware Uniform Common Interest Ownership Act to a pre-2009 common-interest community.
Obtained dismissal at the pleading stage of a federal lawsuit asserting defamation, invasion of privacy, intentional infliction of emotional distress, and related claims against an insured client, with the court finding the challenged statements constituted protected opinion and that the plaintiff failed to sufficiently plead the asserted causes of action.
Successfully defeated a motion to dismiss in a Delaware common-law subrogation action on behalf of an out-of-state insurer seeking recovery of personal injury protection benefits paid under a New Jersey policy. The court held that Delaware’s statutory PIP restrictions did not bar the insurer from pursuing common-law subrogation directly against the alleged tortfeasor.
Obtained dismissal of a Delaware premises liability action arising from an alleged slip and fall on a slippery substance on an apartment stairway. The Superior Court dismissed the action for failure to prosecute and comply with court requirements, concluding that dismissal was warranted under Rule 41(b).
