Michelle Diaz focuses her practice on defending general liability claims in all aspects of litigation in both federal and state courts. Her experience encompasses a wide range of matters, including premises liability, slip and falls, and wrongful death cases involving both passengers and crew members in admiralty and maritime claims.
Michelle manages cases comprehensively, handling tasks such as drafting responsive pleadings, responding to discovery, attending various discovery hearings, conducting witness and expert depositions, participating in mediations, and drafting motions, pre-trial motions, and jury instructions.
In addition, Michelle represents ship owners and cruise line operators in arbitration matters related to crew member injuries, maintenance, and cure, Jones Act claims, and Unseaworthiness. She provides general corporate counsel, advising on proposed company release language and case evaluations with detailed legal analysis and recommendations. Her role also involves extensive legal research, drafting motions and briefs, and handling discovery in various areas of litigation practice, including appeals to the Florida Supreme Court. Michelle has also drafted numerous coverage opinions regarding the application of motor vehicle bodily injury coverage in out-of-state claims, reservation of rights, and denial letters.
