Rafael Soto is a defense litigation attorney who works with clients across a broad spectrum of legal areas. With a focus on litigation, Rafael handles various cases, including general liability, premises liability, automobile liability, uninsured/underinsured motorist coverage, and subrogation matters.

Rafael collaborates closely with insurance companies and an array of clients, ranging from property owners to large commercial and retail establishments. His experience also extends to working with safety consultants and contractors.

Involved in all aspects of the case, Rafael manages claims from the onset, including claims evaluation, depositions, oral arguments and motions. Moreover, Rafael’s experience includes trial proceedings and appellate matters.

Cases and Experience

Secured a significant win for our commercial client by successfully negotiating settlement of the contractual cross claims in a pending personal injury case by securing full and complete defense, indemnification, and additional insured coverage for our commercial client from its Landlord and the Landlord’s insurance company and further successfully arranging for negotiations on the reimbursement of legal fees previously incurred by the client to defend itself pending the acceptance of the tender demand. 

Successfully obtained defense and indemnification for a national entertainment company in premises liability litigation through the strategic enforcement of contractual risk-transfer provisions. By promptly tendering the claim and securing an extension to respond to the complaint, achieved full assumption of the client's defense and payment of legal fees with minimal litigation expense.

Successfully defended a national entertainment company in a premises liability action arising from an alleged fall at a public venue. Following a defense verdict at trial, secured affirmance on appeal when the appellate court upheld the denial of the plaintiff's attempt to assert spoliation and fraudulent concealment claims related to electronically stored information, preserving the favorable outcome for the client.

Successfully dismissed plaintiff’s complaint that alleged Violation of Civil Rights under the New Jersey Civil Rights ACT. This complaint also included additional allegations of Hostile Work Environment and Intentional Infliction of Emotional Distressed. All matters were successfully dismissed via motion practice and oral argument at trial level and at the Appellate Court level, preserving the favorable outcome for the client.
