Responses to the Darker Side of Technology and Family Law

As we advance as a society technologically, there are those who will use these advances for their own nefarious purposes. On a macro level, phishing, spam, and robocalling, did not exist years ago.  Now they are all examples of the nuisances of modern life. On a more focused family law level, something I call electronic harassment has developed. Examples include the defendant in the protection from abuse case who miraculously shows up when the plaintiff and the parties’ children are away for the weekend, or on a routine shopping trip; or the jilted spouse who posts on whatever social media platform about the former spouse’s fidelity issues. This can go even further when the jilted spouse posts on the former spouse’s employer’s social media the same posts, or goes one step beyond and contacts the third party, or even relatives of the third party.
