Received a fully favorable decision from Workers’ Compensation Judge William Gallishen circulated on January 25, 2017, that served to deny and dismiss the employee’s claim petition in its entirety. The claim for a closed period of disability, medical expenses and the employee’s attorney bill was rejected for the employee’s failure to offer credible medical evidence as well as consistent and reliable factual testimony to support the allegation that his acknowledged “medical only” left knee sprain in January 2015 resulted in the medial and lateral meniscal tear for which he sought surgical repair in September 2015.
Obtained a reimbursement from the Pennsylvania supersedeas fund of more than $85,000 for wage and medical benefits for a trucking firm client. The judge cited Weber Gallagher’s use of medical records in issuing his decision.
Obtained the suspension of disability payments and reimbursement of past payments for a swimming pool distributor in litigation with an employee who had refused duties offered him when he was cleared to work. Evidence included the employee’s past convictions for conspiracy to defraud a former employer, uncovered by Weber Gallagher in a search of federal and state criminal court dockets.
