Sarah Elia is a skilled adviser to, and advocate for, her clients. She provides astute representation to financial institutions, business creditors, and debtors in bankruptcy and creditors’ rights matters.

Sarah assists local and national lenders, loan servicers, landlords, title companies, and equipment lessors with transactional and litigation matters. She routinely advises a broad spectrum of financial institutions in all stages of loan documentation, debt restructuring, workouts, enforcement, collection, and related litigation. She also represents creditors’ interests in bankruptcy proceedings.

With broad experience in commercial and residential mortgage foreclosures, receivership actions, real estate matters, quiet title actions, replevin actions, confessions of judgment, ejectment actions, recovery and execution of real and personal property, Sarah is an invaluable member of a client’s advisory team. She works closely with her colleagues and her client’s team to ensure that a seamless service is provided to the client.

Cases and Experience

Verdict in favor of client bank in a real estate foreclosure matter. Defendant unsuccessfully argued that the bank did not possess the Note and Mortgage, and that the chain of assignments to the bank were defective.

Obtained summary judgment (including an appeal victory) in favor of lender client. Defendant claimed that he did not personally guarantee the loan and that his involvement in the loan was strictly as an officer of the corporate borrower.
