Commercial Litigation

We represent businesses, lenders, and owners in high-stakes commercial disputes, protecting their interests in court and at the negotiating table.

Disputes are an inevitable part of doing business. When they arise, our Commercial Litigation team moves quickly to assess risk, define strategy, and pursue practical outcomes. We represent closely held businesses, corporations, developers, lenders, landlords, and institutional clients across the region and nationwide in complex commercial matters.

Our attorneys resolve a wide range of commercial disputes through negotiation, litigation, arbitration, and alternative dispute resolution, including:

  • Breach of contract
  • Partnership, LLC member, and shareholder disputes
  • Breach of fiduciary duty claims
  • Tortious interference with business relations
  • Business torts
  • Enforcement and collection actions
  • Foreclosure and replevin
  • Real estate and commercial property disputes
  • Fraud and fraudulent investment claims
  • Claw-back actions
  • Insurance coverage disputes arising from construction and lending relationships

We represent secured and unsecured creditors in enforcement proceedings and bankruptcy-related litigation. We also counsel employers and business owners in employment-related disputes, including claims involving restrictive covenants, executive agreements, and workplace-related contract issues, working closely with our Employment team.

Because many disputes arise from complex commercial transactions, our litigators work closely with the firm’s Business Transactions team to provide continuity from deal structuring through dispute resolution, allowing us to defend and enforce agreements with a full understanding of the business objectives behind them.
